Abstract

Auch wenn die deutsche Pflegeversicherung im Ausland vielfach als Vorbild gilt, muss nach 20 Jahren konstatiert werden: Es besteht grundlegender Reformbedarf auch über eine Neudefinition des Pflegebedürftigkeitsbegriffes hinaus. Dies ergibt sich aus Defiziten in der Versorgung pflegebedürftiger Menschen und damit verbunden aus Schnittstellen und Problemen im System der sozialen Sicherung. Unter Betonung der besonderen Rolle der Kommunen als Ort, in denen die Pflege geschieht, wird eine Strukturreform vorgeschlagen, die zum einen die heute undifferenziert unter Pflege subsumierten Unterstützungsleistungen in cure und care differenziert. Zum anderen wird eine Neuordnung des Leistungsrechts empfohlen, die zu einem neuen Verhältnis der Verantwortung von Sozialversicherung auf der einen Seite und Kommunen auf der anderen Seite führt. Es wird für essentiell gehalten, die Reform der Pflegeversicherung mit einer Reform der Teilhabe zu verbinden. Optionskommunen die Möglichkeit zu geben, mit der Neuordnung des Leistungsrechts ihre Rolle zu qualifizieren, bietet sich als erster Schritt auf dem Weg in eine große Reform an.

Reform of the German Long-term Care Insurance and Social Participation – Part One: Between Cure and Care

Even though the German long-term care insurance is internationally regarded as an example to be followed, after 20 years it is time to take a closer look and declare: There is a fundamental need to implement reforms and to further develop the legal concept of care. On the one hand, there are deficits in the supply for people in need of care, and related to that there are problems in the system of social security. The local authorities play a very important part because they represent the site where care is taking place. So a structural reform is recommended, that differentiates between cure and care for all the services that are nowadays subsumed under the topic of ‘care’. On the other hand, a reordering of the current benefit system is recommended because this will lead to a new responsibility of the social insurance and the local authorities. It is absolutely essential to connect the reforms of long-term care insurance with a reform of participation. Offering optional local authorities the opportunity to qualify their role by restructuring the benefit system could be a first step on the way to a big reform.
