Abstract

Durch die Einführung des neuen Pflegebedürftigkeitsbegriffs ist Pflege als eine Teilhabeleistung anzusehen. Fundamental ist ein neues Paradigma: Die Steuerung von der Person her, was gleichbedeutend ist mit der Überwindung des bisherigen institutionenzentrierten Ansatzes. Dieser Wandel erfordert eine kommunale Rolle der Koordinierung und die Wahrnehmung ihrer infrastrukturellen Aufgaben. Wenn dies auch nicht allein durch Bundesrecht durchgesetzt werden kann, so ist doch eine Unterstützung durch Bundesrecht erforderlich. Die Schnittstellenbereinigung durch Reformen im SGB V, XI und XII und durch das Bundesleistungsgesetz ist das ergänzende Element, das dazu beiträgt, die Lähmung der Koordination durch Abgrenzungs- und Verschiebestrategien zu verhindern.

Reform of the Long-term Care Insurance and Social Participation – Part Two: The Responsibility of Local Authorities for Coordinating Welfare Benefits

The new legal definition of care involving social participation creates a new paradigm: governance concentrating on the person, which simultaneously means giving up the old approach of opening with the institutional setting of aid and assistance. This change demands a role of the local authorities, their assignment of building up the social infrastructure and coordinating the different agencies responsible for welfare benefits. Notwithstanding necessary efforts of the regional, local and social security agencies, backing by federal legislation is still necessary. Reforming the borderlines between and the cooperation rules for these agencies is a complementary element essential to overcome institutional strategies opposing the best solutions for the clients.
