Abstract

CDU/CSU und SPD hatten für die 16. Wahlperiode ein Gesamtkonzept der Versorgung pflegebedürftiger, behinderter und alter Menschen in Aussicht gestellt. Ihre Reformen haben diesen Anspruch nicht eingelöst. Begriffe, Institutionen und Verfahren des deutschen Sozialrechts, die sich auf Pflege und auf Behinderung beziehen, sind nicht aufeinander abgestimmt. Das ist ein Problem, weil pflegebedürftige Menschen immer auch behindert sind und Unterstützung durch verschiedene Systeme benötigen. Die deutsche Pflegeversicherung ist nicht in gleichem Maße wie das Rehabilitationsrecht auf Selbstbestimmung, Teilhabe und Inklusion ausgerichtet. Sie ist mehr auf Versorgung denn auf einen menschenrechtlichen Ansatz ausgerichtet. Durch die Behindertenrechtskonvention der Vereinten Nationen stehen Pflege und Behinderung auf der Tagesordnung der 17. Wahlperiode.

Long-Term Care and Disability – an Area of Tension

During the 16^th legislation period the CDU/CSU and SPD provided an integrated concept for long-term care, the disabled and the elderly. Their reforms did not, however, deliver. The terms, institutions and processes associated with long-term care and disability assistance have not been brought into harmony with one another. This is a problem, because those who need long-term care are also disabled and so need assistance that is provided by different systems. Insurance in Germany for long-term care is not based to the same degree on autonomy, participation and inclusion as the Rehabilitation Law is. Insurance for long-term care adopts a supply rather than a human rights approach. The Convention on the Rights of Persons with Disabilities will ensure that long-term care and disability remain on the agenda of the 17^th legislation period, which has just started.
