Abstract

Die Einwirkungen der EU auf die nationale Sozialpolitik betonen die Verbindung zwischen Sozialrechts- und Wirtschaftsordnung. Sie sind nicht einseitig, sondern Teil eines wechselseitigen Prozesses, in dessen Verlauf auch das Unionsrecht durch soziale Aspekte angereichert wird. Das bestätigen die jüngsten Vorschläge der Kommission zu den Besonderheiten sozialer Dienstleistungen (vgl. KOM(2011) 896/2 endg.; KOM(2011) 897 endg.; KOM(2011) 900 endg.; ABl. 2012 C 8/24). Nicht zu unterschätzen sind die politischen Maßnahmen der EU. Mit ihnen ist die Initiative zum vergleichenden Lernen von der staatlichen auf die europäische Ebene gewechselt. Zugleich führen sie zur Herausbildung gemeinsamer sozialpolitischer Ziele, hinter denen gemeinsame, in der Grundrechtecharta bestätigte Wertvorstellungen stehen und die der weiteren Entwicklung ein europäisches Fundament bieten.

Social Policy between Nation State and Supra-National Organizations

The effects of the EU on national social policy revolve around the links between social-policy and economic-policy regulations. The effects are not one sided, but are part of an interdependent process that also introduces elements of social policy into EU regulations. This contention is confirmed by recent recommendations by the European Commission on the special characteristics of social services. The EU's policy initiatives should not be underestimated. As a result of such initiatives, the onus to learn from the social policies of others has shifted from the national to the European level. At the same time, they have led to the formation of common social-policy goals behind which a consensus on common values exists. These values are reflected in the Charter of Fundamental Rights. These shared values, in turn, provide a means to develop further a common European foundation.
