The German Federal Constitutional Court (BVerfG) and the Planned Obligation for Self-employed Persons to Join a Statutory or Private Insurance
According to the jurisdiction of the German Federal Constitutional Court (BVerfG), no serious constitutional objections are raised to the planned obligation for self-employed persons to join a statutory or private insurance to cover the risks of old age. If, however, only those persons will be compulsorily insured under the statutory pension scheme who do not (or cannot) make sufficient provisions for old age on the free market, this may, in the long run, weaken the functioning of the pay-as-you-go system. Also with respect to the general need of social protection, coverage by the statutory pension scheme is to be preferred. The situation of the new self-employed is characterized by periods of dependent employment frequently alternating with periods of independent employment and unemployment, and should therefore be constantly covered by an insurance system. Finally, the principle of equality and EU legal implications also suggest the extension of the statutory pay-as-you-go system via insurance coverage of the self-employed, who, to the present, have not been part of the group of compulsorily insured persons.
