Abstract

Nach ihrer Fundamentalkritik von 1998 befasst sich die Monopolkommission 2014 erneut mit der Erbringung sozialer Dienstleistungen in Deutschland. Sah sie damals im Sozialrechtlichen Dreiecksverhältnis ein gesetzlich kodifiziertes bilaterales Kartell, so anerkennt sie heute, dass das im Sozialrecht garantierte Wunsch- und Wahlrecht Wettbewerb unter Leistungserbringern ermöglicht. Allerdings verpasst die Monopolkommission die Chance einer ordnungsökonomischen Neubewertung dieser Marktordnungsform. Dies zeigt sich darin, dass sie weiterhin die Vergabe sozialer Dienstleistungen präferiert ohne zu analysieren, wo ein offenes Sozialrechtliches Dreiecksverhältnis besser geeignet ist, Wahlrechte der Nutzer zu garantieren. Der Vorschlag der Monopolkommission zur Reform der Besteuerung gemeinnütziger Leistungserbringer birgt die Gefahr, diese in marktferne Nischen zurückzudrängen und somit ebenfalls Wahloptionen der Nutzer einzuschränken.

The German Monopolies Commission: Promoting the Beneficiaries' Right to Claim and Choose? – Missing the Mark

In contrast to its fundamental critique of the market of social services in Germany, published in 1998, the German Monopolies Commission acknowledges today that effective competition finds a basis in the Social Code, which promotes the right of beneficiaries to claim und choose. However, the Commission wastes the opportunity to review its position on the triangular market model as established in German social law based on ordoliberal criteria. As a consequence, the Commission continues to give preference to procurement by tender, without analysing in which social service markets the triangular market model is superior in assuring the beneficiaries' right to choose. The Commission's proposal to reform the tax law for non-profit providers runs the risk of pushing them back into remote niches of the social services market, thus further reducing the choices beneficiaries can make.
