Abstract

Der Beitrag untersucht die Auswirkungen der Globalisierung auf die Sozialpolitik. Obgleich durch nationales Recht geschaffen, um den Nationalstaat sozial zu integrieren, war sie seit Anbeginn umfassend in die internationale Rechtsordnung eingebettet. Seit 1945 wurde die Sozialpolitik zum Gegenstand internationaler Menschenrechte. Seither sind diese in der internationalen Rechtsordnung verankert. Unter den Bedingungen von Globalisierung sind die universellen sozialen Rechte als tragendes Fundament von Sozialpolitik zu verstehen. Wie Globalisierung durch den Menschen gemacht ist, ist auch die soziale Gestaltung der Globalisierung dem Menschen zu verwirklichen aufgetragen. Beispiele dafür sind sichtbar; reichen aber noch nicht zu.

Globalization and International Law

This article analyses the role that globalization plays in social policy. Despite being created originally by national law to make the national state a social cohesive one, social policy has, since the very beginning, been embedded in international law. Since 1945, social policy has been a topic of human rights; since that time, some social rights have been enacted by international legislation and have been established on the universal basis of human rights. Under the conditions of globalization, social rights lay the foundations upon which social policy is built. As globalization was made by humankind, this requires international social protection is to be advanced by humankind. Examples are at hand, but they are insufficient to accomplish the aim of adequate social protection.
