Abstract
Die UN-Behindertenrechtskonvention (UN-BRK) enthält als zentrale Bestandteile das Diskriminierungsverbot (Art. 5 UNBRK) und das Prinzip der Zugänglichkeit (Art. 9 UN-BRK). Das Diskriminierungsverbot umfasst ein Gebot angemessener Vorkehrungen (Art. 5 Abs. 3 UN-BRK). Dies sind notwendige und verhältnismäßige Änderungen und Anpassungen im Einzelfall. Das Diskriminierungsverbot wird in Deutschland insbesondere durch das Benachteiligungsverbot (Art. 3 Abs. 3 Satz 2 GG) umgesetzt, im Arbeits- und Zivilrecht auch durch das AGG und das SGB IX. Behindertengleichstellungsgesetze von Bund und Ländern umgesetzt. Beide Konzepte haben erhebliche Wirkungen im Sozial-, Gesundheits- und Bildungswesen und im Arbeitsleben.
Accessibility and Reasonable Accommodations
The Covenant for the Rights of People with Disabilities (CRPD) includes as main concepts nondiscrimination (Art. 5 CRPD) and accessibility (Art. 9 CRPD). Nondiscrimination includes the concept of reasonable accommodation (Art. 5 para 3 CRPD). These are necessary and proportional modifications and adaption in single cases. Nondiscrimination in Germany is implemented through Art. 3 para 3 Grundgesetz, in the Labour and Civil law also through the AGG and the SGB IX. Accessibility is in German law called freedom from barriers and implemented by equal rights laws on the federal and state level. Both concepts are influential for social services, health care, educational services and for the workplace.
