Abstract
In the network industries, two different administrative agencies are potentially responsible for competition issues: the national regulator as well as the competition agency. Such a parallel competency of the regulator and the competition agency is often severely criticized. This contribution argues that competition agencies should have a subsidiary/second-order review competency in the network industries in order to correct deficiencies in the decision-making processes of national regulators, such as information asymmetries or regulatory capture.
