Abstract
The right to "Heimat" according to Art. 11 GG
The debate about the derivation of a right to a homeland from Article 11 of the Basic Law has come to a temporary end since the Garzweiler II decision of the Federal Constitutional Court. The article raises the question to what extent the homeland does not enjoy constitutional protection under Article 11 GG after all. This discussion must always take place in connection with the determination of the scope of protection of freedom of movement. Thus, persons forced to move away because of a lignite mine may be protected not only by an independent right to a homeland under Article 11 GG, but also by other interpretations of the scope of protection.
