Abstract
"Ich müsste mich mit Triepel auseinandersetzen." Heinrich Triepel, Carl Schmitt and The Hegemony
The article discusses general and political differences between Heinrich Triepel (1869-1946) and Carl Schmitt (1888-1985), on the basis of their rather marginal academic contacts prior to 1933, Triepel's late work Die Hegemonie (The Hegemony), published in 1938, Schmitt's detailed review thereof, as well as Triepel's last posthumously published work Vom Stil des Rechts (On the Style of the Law), that distanced itself in neo-humanistic fashion from National Socialism. Triepel was a Wilhelminian Bismarck admirer and monarchist by heart. Where Triepel wanted "Hegemonie" (hegemony) and strictly distinguished it from imperial and dictatorial "rule" (Herrschaft), Schmitt, in the transition to his "Großraumlehre" (Greater Area Policy), insisted on National Socialist "Führung" (leadership). Schmitt's matter-of-fact and respectful positioning towards Triepel highlights the conflict of methods and directions as a "political generational conflict" (Möllers).
