Abstract

The Revision of the French Constitution in 1830. The Constitutional System of the 1814 Charte constitutionnelle and its Account

This article critically examines the revision of the French Charte constitutionnelle in 1830. The aim of the text is threefold: firstly, to show the constitutional and political basis for the regime change taking place during the July Revolution; secondly, to describe the concrete revision of the constitution and to explain the changes which were made, especially regarding the definition and restriction of monarchical power; finally, to assess the political transformation of 1830 in broader contexts. The article reveals the ambivalent character of the constitutional change, which was both ‘preservative’ and ‘revolutionary’. In this context, the widespread thesis of the Restoration regime as a monarchie impossible and the idea that the Revolution of 1830 was an inevitable event in French political history is fundamentally challenged.
