Abstract

Democracy's Intrinsic Legitimization of Constitutional Courts. A Functionalist and Institutionalist Examination

Is judicial review of legislation undemocratic? This question is older than the institution it addresses – and to this day, the answer remains highly controversial. The article aims to bring clarity into the extensive debate and seeks an answer through a layered approach. First, it examines whether an extra-parliamentary competence to reject norms can be justified within a democratic system at all. The discussed reasons for justification include: the protection of individual rights, the promotion and safeguarding of the democratic system, the democratic-legal implementation and – so far hardly ever addressed in German constitutional theory – a representative function expressed in the act of judicial review. At this point, another objective is to make explicit the mostly subcutaneous (implicit/latent?) conceptions of law and democracy within the respective approaches. After that, the focus will be on the institutional design of an extra-parliamentary judicial review competence. The judicial configuration widespread in reality is contrasted with a politicized model of constitutional jurisdiction.
