Abstract
Obstruction in Parliament
Obstruction means parliamentary delaying tactics. Using the example of the Bundestag, the article fully examines obstruction. Numerous minority rights as well as breaches of procedural rules can serve as means of obstruction. Formal procedural rights, such as the right to question the quorum of the Bundestag, are well suited for obstruction. The larger the obstructionist minority, the greater its ability to impair the Bundestag's ability to function. Obstruction is permissible if it is not prohibited by a legal rule. In individual cases, the majority must first counter it with the existing means of defence. Otherwise, a general limitation of minority rights is only possible within constitutional limits. The Bundestag must not turn into a “voting machine” in which the majority can impose its will with only minimal disturbance by the minority. A minority generally willing to be obstructive can hardly be effectively countered once it has reached a certain size (e.g. that of a parliamentary group).
