Abstract
Religious Community as a Constitutional Term - A Systematic Methodological Reconstruction
According to the prevailing opinion a „religious community“ (Article 7, Section 3 and Article 140 of the German Basic Law in conjunction with Article 137 ff. of the Weimar Constitution) is an association bringing together the members of one and the same religious denomination or of several related denominations for the universal fulfilment of the tasks set by the common religious denomination. A reconstruction of that term by systematic interpretation amounts to a modified definition: A „religious community“ is an association that includes followers of a religion as members; its central and self-defined task is the common (but not necessary universal) cultivation of the religion. So Protestant churches are – in harmony with the prevailing opinion – religious communities, Protestant and Catholic parishes aren‘t – contrary to the ruling doctrine: Parishes lack the self-definition of the task „cultivation of the religion“. The same applies to Catholic dioceses because of the pope’s omnipotence. To define dioceses nevertheless – and in accordance with the prevailing opinion – as religious communities it’s necessary to use the historic and the teleologic method of interpretation.
