Abstract
Legitimate Expectations in Fundamental Rights Review
The constitutional protection of legitimate expectations developed by the Federal Constitutional Court exists in conceptual insularity outside of the methodical framework of fundamental rights. An integration is possible by focusing on the moment of infringement. A fundamental right gives a right to continuity in its protected area if there is an element of trust and actual reliance. Genuine and non-genuine retroactivity are variants of infringement that invoke special standards of justification due to their specific burden.
