Abstract
The Internal Effect of Human Rights Treaties in Areas of Exclusive Legislative Competence of the German Länder
The Federal Administrative Court has called into doubt the internal effect of the UN Convention on the Rights of Persons with Disabilities in Germany in cases involving inclusive education, arguing that the Länder had not passed a law giving effect to the Convention. The domestic ratification of human rights treaties at Länder level – in addition to the ratification law at the federal level – has been largely ignored by legal academia. The current paper undertakes to reconstruct state practice at Länder level, thereby unveiling largely diverging views. The paper concludes with a proposal for a novel understanding of Article 1 (2) of the Basic Law in order to avoid implementation deficits.
