Abstract
The rediscovered state of emergency
The discussion of the constitutional problem of the state of exception has experienced a renaissance in recent years, not least because of the Corona pandemic. This article presents and reviews two important new publications on this topic – the writings “Ausnahmeverfassungsrecht” by Anna-Bettina Kaiser and “Der nervöse Staat” by Tristan Barczak. The central arguments of these book are outlined in detail and critically commented. Within this framework, the relationship of the state of exception to the legal order, the relevance of the concept of constitution, the transformation of the state of exception in the preventive state, and the treatment of the teachings of Carl Schmitt and Giorgio Agamben, among others, are examined.
