Abstract
In Germany, employment protection legislation (EPL) has been criticized by liberal economists as a major source of labour market rigidity and slow unemployment growth. In contrast, institutional labour market theories, by pointing to market failures and external effects which can lead to a suboptimal level of private employment protection, provide equity as well as efficiency considerations in favor of EPL. On the background of institutional theories, which consider that the employment impact of EPL is highly dependent on the influence of other labour market institutions, the negative judgement of neoclassical approaches looses its definiteness. These theoretical findings are supported by empirical evidence.
