Abstract
This paper deals with the justification of law in Neo-Kantianism. The analysis focuses both on the widespread misconceptions to which research in the philosophy of law is subject when dealing with this doctrine and on the effects these misconceptions have on the interpretation of the writings of Emil Lask and Gustav Radbruch. The misunderstanding that Neo-Kantianism was hostile to metaphysics has a particularly detrimental effect here: Not only does it obscure the idealistic and religionist character of the Neo-Kantian justification of law, but it also supports the incorrect view that the justification of law in the facts of social reality, typical of legal positivism, is unmetaphysical or free of a priori assumptions.
